Terms of Service

These Terms constitute the Regulamin for electronic services under Polish law. Replace company placeholders with your registered details. Consumer contracts offered to Polish consumers should also be available in Polish.

1. Provider of electronic services

ProPeak provides an online platform connecting learners with native English speakers for on-demand lessons and related digital services.

2. Definitions

“User” means any natural person using the Website. “Account” means a registered user profile. “Service” means ProPeak’s electronic services (browsing, accounts, quiz, bookings, lesson rooms, contact forms).

3. Technical requirements

To use the Service you need:

  • an active Internet connection;
  • a modern web browser updated to a current, supported version (e.g. Chrome, Firefox, Safari, Edge);
  • an active email address;
  • for video lessons: a device with camera and microphone and permission to use them in the browser;
  • JavaScript enabled.

4. Types of electronic services

We provide, among others: access to the public website, account registration and login, placement quiz, tutor browsing and session booking, video lesson rooms, contact and consultation request forms, and administrative tools for authorised staff.

5. Account registration and rules of use

You must provide accurate information and keep credentials confidential. You may not use the Service for unlawful purposes, harass others, attempt to disrupt the platform, scrape content without authorisation, or share account access in a way that violates these Terms.

6. Prohibition of illegal content

Users must not upload, transmit, or otherwise introduce via forms, chat, or other features any content that is unlawful, including content that infringes third-party rights, constitutes hate speech, or violates Polish or EU law. We may remove such content and suspend accounts involved.

7. Bookings and lessons

Session availability depends on tutors and capacity. Specific commercial terms (price, duration, cancellation windows) are shown at booking or in the product offer. Where consumer law applies, mandatory consumer rights remain unaffected.

8. Complaint procedure (postępowanie reklamacyjne)

Consumers may submit complaints by email to propeakacademy@gmail.com or in writing to the Controller’s address, describing the issue and contact details.

We will respond to consumer complaints within 14 days of receipt. If we do not reply within that time, the complaint is deemed accepted under applicable Polish consumer rules where such presumption applies.

9. Termination / deletion of account

You may stop using the Service at any time. You may request account deletion by contacting us at the email above; we will process the request without undue delay, subject to data we must retain under law (e.g. tax records).

We may suspend or terminate access if you materially breach these Terms, after notice where reasonable and required.

10. Liability

We strive for continuous availability but do not warrant uninterrupted operation (maintenance, force majeure, third-party outages). Nothing in these Terms limits mandatory consumer rights or liability that cannot be excluded under Polish law.

11. Changes to the Terms

We may amend these Terms for important reasons (legal changes, security, new features). We will publish the updated Regulamin on this page and, for material changes affecting existing contracts, notify registered users in advance by email or in-app notice with a reasonable lead time. Continued use after the effective date constitutes acceptance where permitted by law; if you do not accept, you may terminate the Agreement free of charge.

12. Governing law and disputes

These Terms are governed by Polish law. Consumers may also benefit from mandatory protections of their country of habitual residence where applicable. Disputes may be resolved before competent Polish courts; consumers may use the EU ODR platform: https://ec.europa.eu/consumers/odr.
